GENERAL
1. MusicalDNA Tool Definition and Purpose
MusicalDNA ("tool"), hosted at appassio.com ("Appassio", "Platform"), is an online tool that analyzes users’ piano performances to provide insights into their playing style by comparing their interpretation to the styles of historical grandmasters of classical piano (collectively "Users", "User", "you", "your"). By uploading a recording, users can receive a detailed analysis, allowing them to improve their interpretation by understanding which grandmasters' styles they resemble. The MusicalDNA service is owned and maintained by IWPD Management GmbH (“the Owner”, “we”, “our”, “us”), located at Algierstrasse 1, 8048 Zurich, Switzerland.
Relationship to Appassio Platform
The MusicalDNA tool is hosted on the Appassio platform. As such, any terms not explicitly covered in these MusicalDNA Terms and Conditions are subject to the general Appassio Terms of Service, which can be found . By using the platform, you agree to adhere to both sets of terms where applicable.
2. Use of the Platform
These Terms of Service ("Agreement") create a legally binding contract between you and the Owner. By using the MusicalDNA tool, you acknowledge that you have read, understood, and agree to the Terms of Service. If you do not agree to the Terms, you must stop using the platform.
If you are under eighteen (18) years of age, your parent(s) or legal guardian(s) must review and agree to the Terms. By using the tool, you represent that your parent or guardian has read and agrees to the Terms of Service and Privacy Policy.
You also acknowledge that you are responsible for your actions while using the tool, including your content, recordings, and interactions with others. The platform is designed to offer a specialized music analysis service—using the platform for any other purpose is a violation of these terms and may result in account suspension or termination without notice.
3. Fair Usage
You agree not to abuse or misuse the platform, including any activities not directly related to improving musical interpretation or receiving analysis through MusicalDNA. Using the platform for unrelated or fraudulent purposes is a violation of these Terms.
4. Account Registration
To use MusicalDNA, you can either analyze your interpretations without registration or create an account for full access to all features. Non-registered users can upload recordings for analysis but will only receive a basic summary of the results. To access detailed feedback and personalized insights, you must create an account, either directly or via a social network (Google, Facebook, etc.).
You must ensure all provided information is accurate, and you are responsible for safeguarding your password. If you are under eighteen (18), your parent or guardian must supervise your registration and usage of the platform. The Owner reserves the right to delete accounts that violate the terms, including impersonation or inaccurate information.
5. Content and Intellectual Property
All Appassio platform content and MusicalDNA tool content, including the interface, musical analysis, design, and branding, is owned by the Owner. You may not copy, modify, or distribute any of the platform's or the tool's content without explicit permission.
When you upload recordings for analysis ("User Content"), you retain ownership but grant the platform a license to use that content for service provision and marketing purposes. The Owner reserves the right to remove or modify User Content at any time without notice.
6. User Conduct
You agree not to engage in harmful or inappropriate behavior while using the platform. This includes sharing harmful content, harassing other users, or uploading malicious software. You are responsible for ensuring your conduct on the platform respects the rights of others, and any breaches may result in immediate suspension or termination of your account.

7. Submission of Recordings for Analysis
Users submit recordings to the tool on the platform for analysis, where the AI model evaluates the performance in terms of interpretation style.
You confirm that you own or have obtained all necessary rights to any recordings uploaded to the tool on the platform. You acknowledge that you are solely responsible for ensuring that your uploaded recordings do not infringe upon the intellectual property rights or copyrights of any third party. The Owner assumes no liability for any unauthorized or infringing content uploaded by Users.
8. Results and Feedback
The results provided by the MusicalDNA platform are based on a machine learning model. While the platform strives to offer accurate and insightful analysis, it cannot guarantee complete accuracy in every evaluation. The feedback is intended as an educational help and should be interpreted accordingly.
9. Limitations of Liability
You understand that the analysis provided by MusicalDNA is for educational and informational purposes only. We make no guarantees regarding the accuracy, completeness, or suitability of the analysis. The platform is not responsible for any actions you take based on the analysis results.
Furthermore, we are not responsible for any damage, harm, or loss resulting from the use of the platform or its content.
TECHNICAL REQUIREMENTS
10. System Requirements
The platform requires users to have a device with functional audio capabilities and a stable internet connection. MusicalDNA operates on most modern operating systems and browsers, including Windows, macOS, iOS, and Android, with supported browsers such as Chrome, Safari, and Firefox.
11. Use of Cookies
We use cookies to improve platform functionality, analyze user interaction, and enhance the user experience. By using MusicalDNA, you consent to the use of cookies as outlined in our .
FINAL CLAUSES
12. Termination for Breach
Your account may be suspended or terminated without notice if you breach these Terms of Service. The Owner reserves the right to take legal action in response to severe violations.
13. Governing Law
These Terms of Service are governed by the laws of Switzerland. By using the platform, you consent to the jurisdiction of the Swiss courts in Zurich, Switzerland.
